Terms of Service

These terms apply when you use Now What (now-what.app). By creating an account you agree to them. If you use Now Whatfor a company, you agree for that company and confirm you may. Questions go to davemen@gmail.com.

Your account

Keep your sign-in secure; you’re responsible for what happens under your account. Only connect accounts and add products you’re allowed to manage.

The authority you grant

• You decide what Now What may do, capability by capability: recommend only, act with your approval, or act on its own within limits. Now What acts only within the capabilities, budgets, capital and guardrails you set, and you can narrow or withdraw any of them at any time.
• Actions happen in your accounts. Ad spend, store changes and site changes are made in the accounts you connected, and the platforms bill you for them directly. Those platforms’ own terms and policies still apply to you.
• You remain responsible for your products, what you sell, and the claims they make. Guardrails you confirm are binding on Now What; guardrails Now What only suggests are not, until you confirm them.

Results

Now What shows how sure it is and what each recommendation is based on, but growth isn’t guaranteed. Projections are estimates, and figures marked Example or Illustration are not customer results.

Plans and billing

Paid plans are billed monthly in advance through Stripe, at the price shown when you subscribe. You can change or cancel your plan in Settings; a cancellation takes effect at the end of the period you’ve paid for. Fees already paid aren’t refunded except where the law requires.

On top of the plan, a managed-capital fee is charged the month after on the ad spend Now What managed that month, as the ad platform billed it, above the amount the plan includes each month: 2% on Launch above $2,000, 1.5% on Grow above $10,000, 1% on Autopilot above $50,000. Spend the platform hasn’t billed, and spend in a currency other than US dollars, carries no fee. If billed spend Now What manages goes past the capital you authorized for a month, that month’s managed-capital fee and any performance fee are waived. The fee never depends on how many actions Now What takes.

Performance pricing is optional and off unless an admin opts in from Settings, and can be turned off there at any time. Opt in and Now What also charges 10% of the estimated incremental contribution its managed Google Ads spend produced, read at the low end of an independently measured return (a holdout, or a study you recorded), and never more than 2% of a product’s billed managed spend that month. A product is charged only when its gross margin is one you confirmed and includes payment fees, its study is under 180 days old and in USD, the month’s spend was no more than the study tested, and the low end of the measured return is above break-even. Months that began before you opted in, and months the spend-limit guarantee covers, carry none. It is a charge on a measured result, not a promise of one.

Acceptable use

Don’t use Now What to break the law or a platform’s rules, to advertise anything deceptive or harmful, to get into accounts or systems you aren’t authorized to use, or to interfere with Now What itself.

Your data

Your products, data and content stay yours. You let Now What use them only to provide the service, as the Privacy Policy describes.

Ending

You can delete your account at any time from Settings → Your sign-in, which deletes your workspace. We may suspend or close an account that breaks these terms, and will tell you why.

Liability

Now What is provided as it is. To the extent the law allows, we aren’t liable for indirect or consequential losses such as lost profits, and our total liability for any claim is limited to what you paid us in the 12 months before it.

Changes

We’ll post changes here with a new date and email you about material ones before they apply. Continuing to useNow What after that means you accept them.
